Guidelines: Fair Use & Creator Rights on LAMINA1
As explicitly called out in the new Creator Studio Item creation flow, by uploading an Item, you attest that you have ownership/permission to post the work, that the work was created ethically, and that you will credit all creators that contributed to this work using the Item Creation flow provided to you on the Lamina1 Hub.
In the context of Lamina1's open metaverse, "fair use" refers to a legal and ethical principle allowing for the limited use of copyrighted material without the need for permission from or payment to the original creator, as long as such use is considered fair, non-commercial, and falls within the defined parameters set by the creator for their work in terms of the V1 Rights Framework, such as Attribution, Commercial Use, and AI interactions.
According to the Lamina1 Hub Terms of Service, by uploading an Item or creation to the Lamina1 Hub using its proprietary toolsets, you attest that:
- Your access and use of LAMINA1’s Technology does not and will not infringe upon the copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any individual or entity.
- The content that you provide to LAMINA1, including your Solely-Owned IP, including all updates, new versions, new releases, enhancements, improvements, and other modifications thereof, but excluding Lamina1’s Technology and Studio Materials, is and shall be your original work (except for material in the public domain or that you otherwise have proper rights to use as part of the Solely-Owned IP) and does not violate or infringe upon the copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any individual or entity.
- Your access and use of LAMINA1’s Technology is and will be at all times compliant with all applicable Laws, regardless of jurisdiction or subject matter in your jurisdiction, including without limitation, laws and regulations related to data privacy, international communications, and the exportation of technical or personal data.
- That LAMINA1 may choose not to display any content from the Lamina1 Hub at any time at its sole discretion, and without notice.
Reporting Content For IP Violations, Misuse, or Misrepresentation
For now, if you believe any work created or shared on the Lamina1 infringes on any of the creator rights or intellectual property protections set by its creator during the Item Creation process, we ask that you fill out this form, accessible via the dropdown menu included with every item on the Lamina1 Hub.
The Lamina1 core team and moderators will then review your claim and potentially take down any content we believe is not following the rules/creator rights established during the Item’s creation.
That said, we know this review process will be unsustainable as the open metaverse we are building expands, and are currently investigating the possibility of a decentralized, community-run protocol to ensure content shared and distributed on the Hub meets the criteria set by future Item, Template, and Space creators –– and can be removed after reaching a common consensus.
